How is leave allowance calculated?
It's calculated by multiplying your daily ordinary wage by your unused leave days. Daily ordinary wage is your monthly ordinary wage divided by monthly standard working hours (209 hours under a 40-hour week) to get an hourly rate, then multiplied by daily standard working hours.
Are there cases where a company doesn't have to pay leave allowance?
If the company legally carried out leave-use promotion procedures required by the Labor Standards Act (written notices twice — 6 months and 1 month before leave expires) and the worker still didn't use their leave, non-payment is exceptionally allowed.
Do I always get paid allowance for remaining leave when I resign?
Generally, yes. The common administrative interpretation is that once resignation makes it impossible to use remaining leave, it must be settled as allowance even if leave-use promotion was carried out.
Is leave allowance taxed?
Yes, leave allowance is classified as earned income and is subject to income tax and the 4 major insurances. The amount that actually lands in your account may be less than this calculator's result.
What if my monthly standard working hours aren't 209?
209 hours is based on a 40-hour work week. If your working hours differ, you need to reflect your actual standard working hours for an accurate daily ordinary wage.
